Trademark Registration Process in Azerbaijan

According to the legislation, the Intellectual Property Agency of the Republic of Azerbaijan registers the trademarks in the country. Resident companies and individuals have the right to apply for trademark registration either directly or via patent attorneys. However, non-resident companies and individuals must apply for the trademark registration only through patent attorneys.

Required Documents for Trademark Registration

To register a trademark in Azerbaijan, you must prepare, collect and submit the following documents:

  • Application for a claim;
  • Power of Attorney (if the Patent Attorney submits the application, and if the applicant is non-resident, the Power of Attorney must be duly legalized);
  • Founding documents of the legal entity applying for trademark registration (for non-residents, founding documents should be duly legalized);
  • If necessary, a document confirming the originality of the trademark in accordance with Article 10 of the Law of the Republic of Azerbaijan on Trademarks and Geographical Indications.

Procedure for Trademark Registration in Azerbaijan

You must follow these practical steps when registering a trademark in Azerbaijan:

  • Submission of Claim Document:

    Firstly, you need to collect, prepare, and submit the necessary documents to the Intellectual Property Agency of the Republic of Azerbaijan. It’s worth noting that you can submit a claim document for trademark registration either online or offline. In Azerbaijan, the processing time for trademark registration applications typically ranges from four to eight months on average.

  • Preliminary Examination of Claim Documents:

    The preliminary examination of the claim documents for the trademark or geographical indication is conducted within one month from the date of receiving the claim documents.

  • Trademark Examination:

    The examination of the trademark is conducted within three to six months after the completion of the initial examination. Following the examination results, an official decision is made to either register or reject the registration of a trademark or geographical indication.

  • Registration:

    Once your trademark is registered, you will receive a Certificate of Registration. A Certificate of Registration is an official document confirming your exclusive rights to the relevant trademark.
